PRIVATE PILOT Ā· DRAFT FOR REVIEW

Restaurant Participation Terms

Version pilot-2026-11-05-v10. These draft terms describe the private test pilot, not a launch-ready legal agreement. Review with qualified counsel before commercial use.

1. Pilot status and authority

These are draft participation terms for the private Meals for Motion test pilot. No real money is collected by the app. By accepting, you confirm that you are authorized to act for the locations registered under your restaurant account. These terms require legal review before commercial launch.

2. Meal and reservation pricing

For new pilot reservations, the driver’s advertised total is $8.50: a $1.50 Meals for Motion reservation fee and $7 paid directly to the restaurant at pickup. The app simulates the reservation fee, including through Stripe sandbox checkout when enabled, only after acceptance. No real money moves in this pilot. The $7 restaurant payment is the final amount due at pickup, including all applicable taxes. Do not add sales tax, mandatory tips, service charges, packaging charges, card surcharges, or other required fees to that amount. The restaurant is responsible for calculating, accounting for, and remitting applicable tax from within the $7 price and providing legally required tax-included disclosures and receipts. The restaurant chooses its accepted payment methods and bears its normal checkout costs. Test pickups require no actual food purchase or payment. Tax treatment and a final commercial refund policy must be settled before real purchases begin.

3. Driver eligibility at pickup

For a kitchen serving multiple registered brands from the same pickup counter, an active delivery pickup for any listed brand at that kitchen satisfies this rule. A shared street address alone is not enough; separate pickup operations do not qualify. All brands on the kitchen listing share one meal per driver per Los Angeles calendar day. Drivers can search by brand name or address and see the brands listed at that kitchen; the kitchen still selects the driver meal, and listing a brand does not promise a particular dish or brand-specific meal. Each driver may collect one discounted meal per restaurant per calendar day, resetting at midnight America/Los_Angeles time for this pilot. Drivers may use other participating restaurants the same day. Only completed pickups count; cancelled, declined, and expired requests do not. Discounted Meals for Motions are available only to gig delivery drivers who are currently collecting a delivery order from that same restaurant. Before handing over the discounted meal, staff must inspect the driver’s live delivery-app order screen and confirm the restaurant matches. A Meals for Motion pickup code, delivery bag, or a claim of being a driver alone is insufficient. Drivers may conceal customer names, addresses, and unrelated personal details; do not photograph, copy, or retain the delivery screen. If eligibility cannot be confirmed, do not hand over the driver meal or enter the pickup code. Use Report Issue on that meal request and select Driver couldn’t verify delivery pickup. The report is linked to the requesting account. A confirmed attempt to collect a driver meal without a current delivery pickup from this restaurant forfeits the meal and any $1.50 reservation fee paid is not refunded. During this pilot, use a clearly identified simulated delivery-screen check instead of requesting real customer information.

4. Meal quality and timing

Offer a complete meal of the kind and quality you normally serve. Plain rice, a side by itself, or food you would not serve to a regular customer does not qualify. Each meal is a surprise chosen by the restaurant. Contents may differ between drivers and visits. Prior meals, examples, and illustrations do not guarantee particular contents. No menu choices or substitutions are promised. Accept only when your kitchen can prepare the meal around the driver’s existing pickup time. Pause availability when you cannot fulfill requests. Do not impose an undisclosed surcharge on a confirmed driver meal.

5. Food must come from your restaurant

Every Meals for Motion must be prepared by the participating restaurant as part of its own food service. Do not purchase prepared meals from another restaurant, fast-food business, or retailer and resell or repackage them as Meals for Motions. For example, buying low-cost hamburgers elsewhere and handing them to drivers is prohibited. Use ingredients your kitchen regularly uses to prepare dishes on its current menu. The finished meal may be a new combination of ingredients or prepared components, provided the result is the kind of dish your restaurant normally serves as a meal. For example, a Thai kitchen may make a rice bowl from its rice, chicken, and carrots even if that bowl is not listed on the menu. Follow safe storage and preparation practices when using previously prepared ingredients. Buying ready-to-eat hot dogs or sandwiches from another business and passing them off as your own meals is prohibited. Having peanut butter for a sauce and bread for another dish does not qualify a peanut butter and jelly sandwich unless that is a type of meal your restaurant normally serves. The same rule applies to a hot dog assembled from ingredients used in unrelated dishes. Normal sourcing of ingredients and kitchen supplies is permitted. Surprise-meal flexibility applies to the contents of your restaurant’s own food, not to substituting another business’s meals.

6. Food preparation and safety

The restaurant is responsible for its food, lawful operation, safe preparation, storage, packaging, and accurate ingredient information. No dietary customization is offered. Answer ingredient and allergy questions accurately; do not represent an unknown meal as safe for a particular allergy. Meals for Motion does not prepare or inspect the food.

7. Keep Meals for Motion reservations in Meals for Motion

While participating, do not solicit, encourage, or arrange with drivers introduced through Meals for Motion to bypass the app for a Meals for Motion discounted-meal reservation in order to avoid the reservation fee. Do not ask drivers to cancel an app request and complete the same arrangement outside the app, or use app-provided driver information to arrange future off-app Meals for Motion reservations for that purpose. Collecting the disclosed $7 directly at pickup is expressly permitted and is part of the service. This restriction does not prohibit ordinary menu sales, publicly available promotions, or independently established customer relationships.

8. Pickup issues and cancellations

After acceptance, the driver is committed to the meal. An emergency that prevents the delivery pickup or a customer-cancelled delivery may excuse the driver. Report the issue as soon as possible. Reports can be submitted later without a late-reporting strike. Any $1.50 reservation fee already paid is retained pending review and refunded for a verified exception or confirmed restaurant fault. A confirmed attempt to collect a driver meal without a current delivery pickup from the same restaurant forfeits the meal and any $1.50 reservation fee paid is not refunded; it also counts as a confirmed driver violation. An unexcused no-show or refusal to pay $7 for a meal offered as agreed can result in retention of the fee and a strike. A reported no-show can temporarily block new requests until the driver explains and provides reasonable verification. Two confirmed strikes can remove a driver or the specific restaurant location. Reports alone do not count as strikes. Aim to hand over both meals together. If the customer’s order is handed over first and the driver’s meal is still unavailable five minutes later, the driver can leave to finish the delivery and report the delay. Drivers can also report a meal below the published standard or an undisclosed payment restriction. Cash only is allowed when disclosed before the driver requests the meal.

What happenedWhat happens after review
Emergency prevented pickup or the customer cancelledIf confirmed, refund any fee paid. No strike.
Driver missed an accepted pickupPause new requests pending an explanation and reasonable verification. An excused absence lifts the hold and gets a refund. A confirmed unexcused absence means a retained fee and a strike.
Driver refused a meal offered as agreedIf confirmed, retain the fee and issue a strike. The refusal does not count as a completed pickup.
Driver attempted meal pickup without a current delivery pickup from that restaurantIf confirmed, forfeit the driver meal, retain any $1.50 reservation fee paid, and issue a strike.
Restaurant did not provide the meal as agreedIf confirmed, refund the fee and issue a strike to that location. Report excessive waits, meals below the published standard, or payment restrictions first disclosed at pickup.

9. Completed pickups and meal preferences

A valid pickup-code confirmation after handoff closes the reservation. Meals for Motion offers no meal ratings and no post-pickup refund for personal taste, dislike of the restaurant-selected contents, or differences from another driver’s or previous meal. This policy does not exclude billing-error review, food-safety concerns, fraud, failure to provide the promised meal, or remedies required by applicable law. The restaurant handles its separate meal payment; Meals for Motion handles its reservation fee. No automatic refund is promised for a report.

10. Privacy and account security

Use driver information only to fulfill and resolve reservations. Do not sell it or use it for unrelated marketing. Protect your account and permit only authorized people to manage restaurant locations.

11. Participation and changes

A restaurant can pause new requests or stop participating. Meals for Motion may pause a listing for repeated fulfillment failures, misuse, or suspected fee avoidance, and will provide the reason and a way to request review through the pilot operator. No automatic monetary penalty or permanent exclusivity is imposed by these draft pilot terms. Material updates require a new affirmative acceptance before new requests resume.
